1. Policy scope
1.1 In the course of carrying out our activities, R.E.-Sell Projects Pty Ltd (ACN 699 692 003) will collect, store, use and disclose personal information about individuals who engage with us (you). We are committed to the protection of your personal information and to compliance with Applicable Privacy Laws.
1.2 This policy has been developed in accordance with the privacy laws applicable to our business, including:
(a) the Privacy Act 1988 (Cth) (including the Australian Privacy Principles); and
(b) any other applicable laws which applies to how we collect, store, use and disclose your personal information,
(together, Applicable Privacy Laws).
2. Personal information and sensitive information
2.1 Personal information is information or an opinion about an identified or reasonably identifiable individual, whether or not the information or opinion is true and whether or not the information is recorded in a material form. This includes sensitive information, which refers to specific classes of personal information that are afforded additional protection under Applicable Privacy Laws, such as a person's racial or ethnic origin, membership of professional or trade association or union, and criminal record.
2.2 Together, for the purposes of this policy, personal information refers to personal information and sensitive information, unless otherwise specified.
3. Types of personal information we collect and hold
3.1 We collect and hold your personal information in the course of providing our products and services, and for purposes connected to the provision of those products and services (together, our activities).
3.2 Consistent with our activities, the types of personal information we may collect and hold includes the following:
(a) Identity and contact details. When you engage with us, we may collect your name, date of birth, gender, address, telephone numbers, email addresses, employment information, and other identifying and contact information.
(b) Service preferences. In providing our services to you, we will collect personal information regarding your preferences including style and aesthetic preferences and lifestyle information.
(c) Real estate information. We collect information about the prospective and actual sale of the property for which we have performed our services, including lender details, agent details, sale price, market information and other relevant information.
(d) Other information. We collect text of written and oral communications gathered in the course of our interaction with you, including where you interact on live-chat, social media and emails, provide feedback and online reviews and other information from your interactions with us online, cookie information, IP address, URLs, search histories and other associated information.
3.3 Our operations do not ordinarily involve the collection of sensitive information, however if sensitive information is collected we will only collect it to the extent that it is reasonably necessary for one of our functions or activities.
4. How we collect and hold personal information
4.1 The ways we may collect your personal information are as follows:
(a) Directly from you. We may collect personal information directly from you in the course of undertaking our activities, from communications via phone, email and text, as well as from our website and other online platforms including by using cookies.
(b) From publicly available sources. We may also collect personal information from publicly available sources of information, including via websites, directories, social media channels, and government registers including land registry records and the Personal Property Securities Register, where relevant.
(c) From third parties. Third parties with whom there is an existing relationship either with us or with an individual may provide us with personal information for the purposes of engaging with or facilitating our activities, including real estate agents, building contractors, financial institutions and credit providers. We will only collect personal information from third parties where it is unreasonable or impracticable for us to collect it from the individual concerned.
4.2 We take reasonable steps to ensure the security and integrity of the personal information we collect, store, use and disclose. Personal information is held securely, is subject to various security protections and is held only for as long as the information remains relevant to the purpose for which it was collected. We implement protections in line with industry standards to safeguard personal information against unauthorised access and/or loss, including steps to ensure all traffic is encrypted, access is restricted to a limited set of IP addresses and all servers are protected by anti-malware and virus software.
4.3 You can elect to not provide us with personal information, withdraw consent for our use of personal information, or engage with us anonymously or using a pseudonym. In these circumstances, however, we are unlikely to be able to provide you with our products or services.
5. Purposes for which we hold, use and disclose personal information
5.1 We will not use or disclose personal information for any secondary purpose, unless:
(a) that secondary purpose is related to the purpose for which we collected that information initially, and the information is used in a manner reasonably expected in the circumstances; or
(b) you consent to that use or disclosure.
5.2 The purposes for which we collect, hold, use and disclose information may include:
(a) conducting our business, which includes undertaking our activities and engaging with you in respect of our activities, as well as referring you to relevant third parties;
(b) to communicate information to you about our activities;
(c) to provide you with information or advertising relating to our activities (including targeted advertisements) or marketing communications we believe may be of interest to you;
(d) to improve and optimise our platforms (including our websites) and services;
(e) for use with our recruitment activities;
(f) for our internal administrative, research, planning and marketing purposes;
(g) to comply with legal obligations and protect our legal interests and rights (including our intellectual property rights);
(h) to determine whether our products or services are appropriate for you;
(i) to engage third parties to carry out services on our behalf; and
(j) to disclose information where relevant to our related bodies corporate.
5.3 We may also disclose personal information to the following third parties for their use for the same purposes:
(a) our affiliates and related bodies corporate;
(b) third party contractors and subcontractors who we have engaged to perform services for you on our behalf; and
(c) third party technology and marketing partners, including but not limited to Google Analytics and other technology and marketing service providers, or their respective marketplaces.
5.4 While our disclosure of personal information to such third parties is governed by this Privacy Policy, such third party's use of your personal information, including contacting them with any queries you have about the personal information they hold and how those parties use your personal information will be governed by their privacy policy. It is your sole responsibility to review such privacy policies.
6. Changes to this Privacy Policy
6.1 We will review and update this Privacy Policy from time to time as needed without notice. Therefore, you should review the terms of this policy periodically to make sure that you are aware of how we collect, hold, store, use and disclose personal information. The date listed at the end of this document indicates when this Privacy Policy was last updated.
6.2 If we make a material change to our Privacy Policy and the way in which we handle your personal information, we will inform by issuing a notice that includes a summary of the change. This notice may be provided through our website, via email or through other appropriate communication channels.
7. Retention, access and correction
7.1 We will only keep records of your personal information as long as they are still necessary for the purposes for which we collected such personal information.
7.2 We will take all reasonable steps to ensure any personal information we collect, use or disclose is up to date and accurate. If you believe personal information that we hold about you is not up to date or accurate, you may ask us to correct it.
7.3 You may ask us to provide you with details of the personal information we hold about you, and copies of that information. We will respond to your request and attempt to provide you with the data within 30 days of receipt of your request.
7.4 If we provide you with copies of the information you have requested, to the extent permitted by law, we may charge you a reasonable fee to cover the administrative costs of providing you with that information.

8. Complaints and contacting us
8.1 If you consider a breach of the Privacy Act 1988 (Cth) has occurred, you may direct your query to our privacy officer using the details set out below and we will attempt to resolve your complaint.
8.2 We would appreciate the chance to deal with your concerns before you approach the relevant authority so please contact us in the first instance. If you do not consider our response satisfactory, you may contact the Australian Privacy Commissioner at its website www.oaic.gov.au or by telephone on 1300 363 992.
